These Terms and Conditions (“Agreement”) govern the use of services provided by YanaPhleb LLC ("we", "us", "our"), a phlebotomy service provider. By utilizing our services, you ("client", "you", or "your") agree to abide by these terms.

1. Services Provided

We offer professional phlebotomy services, including blood collection for lab tests, medical testing, blood donation, and other services related to blood specimen collection. Our phlebotomists are trained and certified to perform these services at your location or in other agreed-upon settings.

2. Booking and Appointment Scheduling

  • Appointment Requests: Appointments can be booked via our website, phone, or email. Booking requires accurate information, including your name, contact details, and medical information (if applicable).

  • Confirmation: You will receive a text message to confirm your appointment 24 hours, please replay “yes” to confirm or “no” to cancel.

  • Cancellations: You may cancel or reschedule your appointment up to 48 hours in advance. You will not receive a refund if 48-hour notice is not provided as the majority of the preparation will have already been completed.

 

3. Payment

  • Pricing: The cost of phlebotomy services is based on the type of service requested and any additional requirements, such as special equipment, rush delivery, travel distance and the number of laboratories. You will be provided with a pricing estimate upon booking.

  • Payment Methods: Payments can be made by credit card, debit card, or other available methods. Full payment is due at the time of service unless otherwise specified.

  • Late Payments: Any outstanding payments must be paid within 30 days. Late payments may incur additional fees as specified in your invoice.

 

4. Client Responsibilities

  • Accurate Information: You are responsible for providing accurate and complete medical information at the time of booking, including any health conditions, allergies, or medications that may impact the procedure.

  • Preparation: You are responsible for following any preparation instructions provided by us or your healthcare provider to ensure the procedure is successful.

  • Cooperation: You agree to cooperate with the phlebotomist during the procedure. If you are unable to cooperate or require special assistance, please inform us in advance so we can accommodate your needs.

  • Pets: PUT ALL PETS AWAY AT THE TIME OF THE APPOINTMENT.

 

5. Service Limitations

  • Medical Conditions: Our phlebotomy services are not a substitute for medical advice, diagnosis, or treatment. If you experience any medical complications, you should seek immediate medical attention.

  • Inability to Perform Service: If our phlebotomist determines that the service cannot be safely performed due to medical concerns or client non-cooperation, the service may be postponed or canceled without refund.

  • Non-Guarantee of Results: We cannot guarantee the accuracy or results of any medical tests or lab results related to blood collection. You should consult with your healthcare provider regarding any concerns.

 

6. Privacy and Confidentiality

  • Confidentiality of Data: We respect your privacy. Any personal and medical information collected is treated confidentially and in compliance with applicable data protection laws.

  • Data Usage: Your personal information may be used for appointment scheduling, billing purposes, and communication regarding services. We will not share your personal data with third parties without your consent, except when required by law.

 

7. Liability

  • Limitation of Liability: Our liability for any service-related issue will be limited to the amount paid for the service in question. We are not liable for indirect, incidental, or consequential damages resulting from the use of our services.

  • Injury or Accidents: You agree to release and hold YanaPhleb LLC harmless from any claims, damages, or injuries that may occur during the provision of phlebotomy services, except in cases of gross negligence or willful misconduct on our part.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless YanaPhleb LLC, its employees, contractors, and affiliates from any claims, losses, liabilities, or expenses (including legal fees) arising from your use of our services or violation of these Terms and Conditions.

 

9. Changes to Terms and Conditions

We reserve the right to modify, update, or change these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services will be considered acceptance of these updates.

 

10. Governing Law

These Terms and Conditions are governed by the laws of New Jersey. Any disputes arising out of or relating to these terms will be resolved in the competent courts of New Jersey.
